What you should know

Boxer Capital Management, LLC along with our affiliates (collectively, “Boxer Capital”, “we,” “us,” “our”) respect your concerns about privacy. We recognize the importance of keeping information about you confidential and secure and are committed to protecting the nonpublic and personal and financial information of our clients and consumers who obtain or seek to obtain financial products or services. We fulfill this commitment by establishing and implementing policies and systems to protect the security and confidentiality of this information.

This Privacy Notice describes the types of personal information we obtain, how we use that information, to whom we disclose it and the choices available to individuals to which we provide products or services and which are used for personal, family or household purposes. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices

This Privacy Notice applies as between Boxer Capital and consumers to whom we provide financial products and/or services (such consumers referred to herein as “you”, “your”, “yours”).

This Privacy Notice applies to our privacy practices with respect to our processing of personal information online through our website as well as our offline privacy practices (unless they are specifically covered by a separate privacy policy)

Safeguarding Your Information

We limit access to nonpublic personal and financial information about you to those employees and other persons who need to know the information in order to provide products or services to you. Boxer Capital maintains physical, electronic, and procedural safeguards that we believe are reasonably designed to comply with federal standards to protect your nonpublic personal and financial information. If you decide at some point either to close your account(s) or to become an inactive client, we will continue to adhere to the privacy policies and practices described in this notice.

Categories of Personal Information We Collect

Depending on the products and services you use, we may collect the following types of nonpublic personal and financial information about you:

  • Your name, address, telephone number, e-mail address, name of current or former employer, birth date, driver’s license number, social security number, tax identification number, signature, bank account information, and other similar personal and financial information, from you and from identification cards (e.g., passport and driver’s license) and papers you submit to us on applications, subscription agreements, forms you complete via our website, and other forms of communication.
  • Information about your account balances and financial transactions with us, our affiliated entities or nonaffiliated third parties from our internal sources, from affiliated entities and from nonaffiliated third parties. This includes information about redemptions and additions to your accounts.
  • Information about your balances and financial transactions and other personal and financial information, from consumer credit reporting agencies or other nonaffiliated third parties to verify information received from you or others as well as information from third parties such as consultants, referring brokers or advisers, managers, product sponsors and clearing firms, and their service providers.

Boxer Capital may combine any nonpublic personal and financial information we collect online with information collected from or about you in other contexts. This may include information collected online, such as through email exchanges with you, from publicly available sources, such as your company website, or from offline sources, such as information that is collected when you call. CATEGORIES OF INFORMATION WE DISCLOSE

Boxer Capital occasionally discloses nonpublic personal and financial information about you to affiliated and non-affiliated third parties as permitted by law, including in the following instances,

  • To our affiliates for proper business purposes in connection with the provision of management and other services to you and to administer your account and commingled investment vehicles in which you are invested;
  • To non-affiliated third parties (such as brokers, custodians, attorneys, auditors and administrators) as necessary for us to provide agreed upon services and products to you consistent with applicable law. Such entities are not allowed to use your non-public personal information for their own purposes and are contractually obligated to maintain strict confidentiality. We limit their use of your non-public personal information to the performance of the specific services we have requested;
  • To communicate with you as our client, our client contact or employee, and to communicate with persons we believe to be your authorized agent or representative;
  • To market our products and services;
  • To manage our business operations, including but not limited to: managing our products and services; collecting money that is owed to us; and making payments for products and/or services rendered;
  • To process any job application submitted by you;
  • To manage privacy and security;
  • To aid in the detection and prevention of financial crimes;
  • To comply with our regulatory requirements; and
  • To respond to court orders and other legal proceedings, such as responding to a subpoena.

Boxer Capital may disclose nonpublic personal and financial information concerning you to law enforcement agencies, federal or state regulatory agencies, self-regulatory organizations or other nonaffiliated third parties, if required or requested to do so by a court order, judicial subpoena or to comply with a legal or regulatory obligation

When your nonpublic personal and financial information is disclosed to unaffiliated third parties, they are not permitted to use the information for any purpose other than to assist our servicing and administration of your account(s), including helping us improve the services we offer, or as permitted by law

Nonpublic personal and financial information may be stored by Boxer Capital for an indefinite period of time. Access to such information is limited to those personnel who need to know the information in order to provide products or services to you and is password protected

Information About Our Former Customers

Boxer Capital does not disclose nonpublic personal and financial information about former customers to nonaffiliated third parties unless required for legal or regulatory purposes, including if requested to do so by a court order, judicial subpoena or regulatory inquiry, or otherwise where we believe in good faith that disclosure is required or permitted by law. Furthermore, Boxer Capital does not disclose nonpublic personal and financial information about former customers to nonaffiliated third party systems unless such system was used to service your account.

“Shine the Light” Disclosure

“Shine the Light” Disclosure The California “Shine the Light” law gives you the right to opt out of the sharing of certain categories of personal information (as defined in the Shine the Light law) with third parties for their own direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes.

Our Privacy Notice

Our current Privacy Notice, and our Privacy Policy, will be posted on our Site and any updates will be effective upon posting. You are responsible for periodically checking this Site for updates. We reserve the right to amend this Privacy Notice at our discretion and at any time. If you use our Site or continue to use our services after any changes to the Privacy Notice have been posted, that means you agree to the updated Privacy Notice
